Metriks Terms of Use

These Terms are a legal agreement. They include fitness and health disclaimers, subscription terms, limits on liability, and an arbitration agreement with a class-action waiver. Please read them carefully.

1. Agreement to These Terms

These Terms of Use (the "Terms") govern your access to and use of Metriks, including the Metriks mobile application, web pages, widgets, notifications, Rep Assistant features, social features, subscriptions, and related services (together, the "Service"). The Service is operated by Ian de Oliveira ("Metriks," "we," "us," or "our").

By creating an account, using the Service, tapping to accept, or continuing to use the Service after these Terms are updated, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Metriks, or older if the minimum age to use an online service or enter into these Terms is higher where you live. If you are under 18 or under the age of majority, legal capacity, or digital consent where you live, you may use Metriks only if your parent or legal guardian has reviewed these Terms and our Privacy Policy with you and consents to your use of the Service. By allowing a minor to use Metriks, the parent or legal guardian agrees to these Terms on the minor's behalf and is responsible for the minor's use of the Service. You may not use the Service if you are barred from doing so under applicable law.

3. Fitness, Health, and Safety Disclaimer

Metriks is a fitness logging, planning, analytics, and social tool. Metriks is not a medical device, health care provider, personal trainer, dietitian, or emergency service. The Service does not provide medical advice, diagnosis, treatment, or individualized clinical recommendations.

Workout plans, split predictions, exercise progression suggestions, estimated one-repetition maximums, load-curve values, calorie estimates, acute-to-chronic workload ratio, training readiness, proximity-to-failure analysis, heart-rate summaries, isometric duration and RPE tracking, Rep Assistant responses, and other outputs are informational estimates based on available data. They may be incomplete, inaccurate, delayed, or inappropriate for your body, health status, equipment, experience, or environment.

You are responsible for deciding whether exercise is safe for you. Consult a qualified health professional before starting or changing exercise, especially if you have a medical condition, injury, pregnancy, symptoms, medications, or concerns. Stop exercising and seek medical help if you experience chest pain, fainting, severe shortness of breath, unusual symptoms, or an emergency.

4. Rep Assistant and Automated Insights

Rep Assistant may summarize your workouts, metrics, goals, training identity, split, previous splits, upcoming workout, ACWR, and other training context. It may use your profile, workout history, exercise library, split history, weight history, heart-rate data, custom exercises, social settings, purchase entitlement status, and derived metrics to generate responses.

Rep Assistant outputs are not guaranteed to be correct, complete, safe, or suitable. You should review recommendations before relying on them, and you should not use Rep Assistant as a substitute for professional judgment, coaching, medical care, or your own safety decisions.

5. Accounts and Security

You are responsible for the accuracy of your account information and for maintaining the confidentiality of your sign-in methods. You must promptly notify us if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms, create risk, or misuse the Service.

6. User Content and Workout Data

You retain ownership of workouts, profile information, custom exercises, goals, notes, social activity, and other content you submit ("User Content"). You grant Metriks a limited, worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, transmit, and use User Content only as needed to operate, secure, support, improve, and provide the Service.

You are responsible for User Content you submit. Do not submit content that is unlawful, harmful, misleading, infringing, abusive, or that violates another person's rights.

Custom exercises, muscle classifications, split templates, retrospective workout logs, isometric durations, RIR, RPE, and other manually entered values are user-provided data. You are responsible for checking that they are accurate and appropriate before relying on related metrics or recommendations.

7. Social Features and Sharing

Metriks may let you send friend requests, accept friends, share lift activity, share PRs, appear on leaderboards, or view friend workout summaries. You control certain sharing settings, but you should assume information you choose to share with friends may be seen, saved, or disclosed by those friends.

You may not use social features to harass, impersonate, spam, scrape, collect personal information, send unwanted requests, or post unlawful or harmful content. We may remove content, restrict social features, or suspend accounts to protect users or the Service.

If you believe social content, friend requests, PR activity, leaderboard activity, or another user's behavior violates these Terms, use the in-app report or block controls or contact us at metrikssupport@gmail.com. We may review reports and take action such as limiting sharing, removing content, blocking access to social features, or suspending accounts.

8. Apple Health, HealthKit, Devices, and Wearables

If you connect Apple Health, HealthKit, Apple Watch, widgets, Live Activities, or other device features, you authorize Metriks to access only the data types you grant through the operating system. You can change those permissions in your device settings. Metriks does not use HealthKit data for advertising, data brokerage, or unrelated marketing.

Device and wearable data can be delayed, unavailable, or inaccurate. You should not rely on Metriks, Apple Health, Apple Watch, or connected-device data for emergency or medical decisions.

Lock screen widgets, Live Activities, rest timers, checkmarks, RIR actions, heart-rate collection, and notifications may be interrupted by device settings, battery conditions, operating system limits, network availability, or wearable connectivity.

9. Subscriptions, Purchases, Trials, and Cancellations

Some features may require Metriks Pro or another paid entitlement. Purchases made through Apple's in-app purchase system are processed by Apple and are subject to Apple's terms. Prices, renewal terms, trial eligibility, taxes, and billing periods are shown before purchase.

Subscriptions renew automatically unless canceled through your Apple ID subscription settings before the renewal deadline. Deleting your Metriks account or removing the app does not cancel an Apple subscription. Refund requests must be submitted to Apple unless applicable law requires otherwise.

We may use transaction identifiers and account records to associate paid access with the Metriks account that purchased or redeemed it. Restoring purchases may require you to sign into the same Metriks account and the same Apple ID used for the purchase.

If Metriks offers "Lifetime Access," that means access to the covered Metriks Pro features for the commercial and operational lifetime of the Metriks app and service, subject to these Terms, continued app and service availability, platform rules, and changes required by law. Lifetime Access does not guarantee that Metriks, any specific feature, third-party service, or platform integration will be available forever.

10. Free Access and Data Limits

Free versions of Metriks may limit access to older history, advanced metrics, Rep Assistant prompts, longer date ranges, or other features. Data may remain stored even if a free account cannot view all of it. Feature limits may change over time.

Metriks may use local caching to make the app faster and reduce unnecessary cloud reads. Cached data is intended to mirror your account data, but it may briefly differ from the cloud copy during sync, offline use, network interruptions, or conflict resolution.

11. Notifications and Live Activities

If you enable notifications, Metriks may send workout reminders, rest-timer updates, friend activity, PR activity, goal pace notices, or other Service-related messages. Notifications may be delayed or fail to deliver. You can manage notification permissions in your device settings.

Goal pace notices are estimates based on saved goal intervals and available data. They are not medical, financial, or professional advice and may not appear every time your data changes.

13. Intellectual Property

The Service, including software, design, names, logos, graphics, text, and other materials, is owned by Metriks or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. You may use the Service only as permitted by these Terms.

14. Third-Party Services

Metriks may rely on third-party services such as Apple, Google, Firebase, hosting providers, analytics or crash reporting tools, and payment infrastructure. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

15. Account Deletion and Service Changes

You may request or use available tools to delete your account. Deletion may remove or anonymize data according to our Privacy Policy, but some records may be retained where required for security, legal, billing, fraud-prevention, backup, or legitimate business purposes. Account deletion does not cancel Apple subscriptions.

We may change, suspend, or discontinue all or part of the Service at any time. We may also update features, limits, pricing, supported platforms, or data requirements.

16. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Metriks disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

17. Limitation of Liability

To the maximum extent permitted by law, Metriks and its owners, operators, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, workout injury, health consequences, loss of goodwill, or service interruption arising from or related to the Service.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid to Metriks for the Service in the 12 months before the claim or $100.

18. Indemnification

You agree to defend, indemnify, and hold harmless Metriks and its owners, operators, service providers, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of law or another person's rights.

19. Dispute Resolution, Arbitration, and Class-Action Waiver

Before filing a claim, you agree to contact us at metrikssupport@gmail.com and try to resolve the dispute informally for 30 days. If it is not resolved, any dispute arising from or related to these Terms or the Service will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court or seek injunctive relief for intellectual property misuse or unauthorized access.

You and Metriks waive the right to a jury trial and the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding. You may opt out of arbitration by emailing us within 30 days after first accepting these Terms with your name, account email, and a clear statement that you opt out of arbitration.

20. Governing Law

These Terms are governed by the laws of California, excluding conflict-of-law rules, except where your local law requires otherwise.

21. Changes to These Terms

We may update these Terms. If changes are material, we will provide notice through the Service or by another reasonable method. The updated Terms become effective when posted or as stated in the notice. Your continued use of the Service after the effective date means you accept the updated Terms.
